Terms of Service

These Terms of Service ("Terms") govern your use of the midswing.app website and, once launched, the Midswing mobile application (together, the "Service"), operated by Midswing, Inc. By using the Service you agree to these Terms.

The service

Midswing provides GPS-based golf round tracking, statistics, and insights. The Service includes a free tier and an optional paid subscription ("Midswing Pro"). Features may change as we develop the product, particularly before and during early access.

Accounts

You must provide accurate information when creating an account and are responsible for activity under it. You must be at least 13 years old to use the Service.

Subscriptions and billing

• Midswing Pro is offered at $9.99/month or $79.99/year, billed through the Apple App Store or Google Play. Pricing may change; existing subscribers will be notified before any change affects them.
• Subscriptions renew automatically until cancelled. You can cancel anytime through your app store account settings; access continues until the end of the paid period.
• Refunds are handled by the app stores under their policies.

Acceptable use

You agree not to misuse the Service — including attempting to access other users' data, reverse-engineering the app, scraping the Service, submitting false data to manipulate handicaps or benchmarks, or using the Service in violation of law.

Your data and our license

You own your personal data. By using the Service, you grant us a license to process your data to operate and improve the Service, and to create aggregated or de-identified datasets as described in our Privacy Policy.

Accuracy disclaimer

GPS-based tracking is inherently approximate. Shot zones, distances, and insights are estimates derived from location data and course maps, and may contain errors. The Service is provided for informational and entertainment purposes; handicap calculations follow USGA methodology but official handicaps are maintained by authorized golf associations.

Intellectual property

The Service, including its design, software, and content, is owned by Midswing, Inc. and protected by law. These Terms grant you a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Midswing will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose.

Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination will survive.

Changes and governing law

We may update these Terms; material changes will be posted here with a revised date. These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules.
